TERMS AND CONDITIONS OF THE RONDO PAID UNGUARDED CAR PARK


§1

The premises of the car park shall be considered the closed, multi-car garage No 3 and other places visibly marked with the Rondo logo, located in Świnoujście at Piastowska 35, constituting and integral part of the residential-gastronomy compound “RONDO Ristorante”, in short “the Rondo Car Park”, hereinafter called the Car Park

§2

The Car Park and its security staff are managed by the Towarzystwo Budowlane ARKADA sp. z o.o., Świnoujście Monte Cassino 16/1 hereinafter called the Manager.

The Operator collecting payments for parking at the Rondo Car Park shall be ARKADA - INWEST Spółka z o. o., Szczecin, Merkatora 7, 70-676 Szczecin. 

§3

A vehicle user (hereinafter called the User) shall be considered a person authorised to control a vehicle.

§4

  1. The User concludes a rent agreement for parking space at the Car Park with the Operator according to the conditions specified in these Terms and Conditions and the law dated April 23rd 1964, Civil Code (i.e., Dz.U. 2019, item 1145), at the moment of: 
  2. paying for a parking space, or 
  3. leaving a vehicle at the Rondo Car Park without paying for parking space
  1. Concluding the agreement for parking space in a manner specified in sec. 1 is equivalent to agreeing to all the provisions of these Terms and Conditions.
  2. After concluding the agreement for renting parking space in a manner specified in sec. 1, p. 1. the User who contacts the reception of Rondo during the working hours of the reception obtains a parking card, including: 
  1. the number of parking space,
  2. parking (renting) period,
  3. registration number of the vehicle,

which the User shall be obliged to place on the vehicle cockpit, under the windscreen. 

  1. After concluding the renting agreement in a manner specified in sec. 1, p. 2. the User is obliged to contact the reception of Rondo without unnecessary delays in order to make a payment for the parking space and obtain the parking card, specified in sec. 3, and to place the parking card in the place specified in sec. 3. 
  2. User parking without a parking card is obliged to pay the Operator a fee of PLN 100 per day. 
  3. If the User fails to contact the Reception of Rondo in a manner specified in sec. 4, the Operator shall place a note behind the vehicle wipers, requesting to contact the Reception of Rondo in order to make the payment for the parking space, which note shall include the date and time of its placement. If the User fails to contact the reception of Rondo 

and make the due payment for the parking space within 12 hours from the time of placement of the notethe Operator shall have the right to install a lock on the vehicle. As the lock is installed, the Operator shall place a notification behind the vehicle wiper, requesting the User to contact the reception of Rondo (during the working hours of the Reception) or the facility security staff (outside the working hours of the reception of Rondo). The necessary condition for the lock to be removed is the payment the Car Park Operator for removal of the lock, amounting to PLN 100, as well as payment of the fee for the parking space for the whole period when the space was used.

§ 5

  1. The Car Park is unguarded, paid according to the Operator’s price list, available at the reception of Rondo.
  2. The Operator shall not be held responsible for any damage to the motor vehicles parked at the Car Park nor for any belongings left in the vehicles.
  3. The Operator shall not be held responsible for any damage caused by the vehicle drivers, other persons present at the Car Park nor third persons (including theft, break-ins, mugging).
  4. The vehicle User shall be responsible for all damage inflicted to the Operator or third persons at the Car Park.
  5. The costs resulting from a failure to follow the Terms and Conditions shall be incurred by the User or other person, whose actions caused the costs, authorised by the User to drive the vehicle.
  6. The Manager or Operator are responsible only for proved damage caused by their failures, including resulting from failures of their employees.

§ 6

  1. The Car Park is open all day, every day of the week.
  2. The Car Park is designated for passenger cars and commercial vehicles of up to 3.5 tonnes. Liquefied gaspowered vehicles shall not be allowed to enter and park at the Car Park

§ 7

  1. At the premises of the Car Park, the provisions of the law dated June 20th 1997 - Traffic code (i.e., Dz. U. of 2018 item 1990 as amended) are applicable. The maximum allowed speed of vehicles at the Car Park is 5 km/h.
  2. At the Car Park, the driver of a vehicle is obliged to follow all vertical and horizontal traffic signs, as well as numeric designations of parking spaces.
  3. The vehicle may only stay at the parking space designated with the number assigned to the User by the Operator. If this point is not followed or if the payment was not provided in spite of a lock being installed for more than 14 days from the delivery of the notice, described in p. 5 § 4, the Manager has the right to remove the vehicle according to section 9 of the Terms and Conditions.
  4. On one parking space designated for cars it is allowed for no more than two motorcycles to be parked.
  5. While performing the parking manoeuvre, the driver of a vehicle is obliged to be particularly careful, and all manoeuvres shall be performed in a manner that will not damage other vehicles at the Car Park and will place the vehicle in a designated space without covering the lines (according to the axis of a niche). The vehicle should stationary with the ignition and the lights switched off.
  6. The Operator and Manager have the right to monitor the correctness of parking of the vehicles. In cases where the rules of using the Car Park are unclear, the Operator should be contacted.
  7. At the Car Park it is forbidden to:
  1. smoke tobacco or use open fire;
  2. consume alcohol or narcotic drugs;
  3. pollute the Car Park (particularly with contents of ashtrays);
  4. disturb public order (e.g., by deliberate noise, performing or playing loud music);
  5. wash or hoover the vehicle, fix, replace consumable fluids, petrol or oil;
  6. leave the vehicle with running engine without justified reason;
  7. perform service-repair works on the vehicle or fuel it without justified reason;
  8. leave unattended children in the vehicle;
  9. leave unattended animals in the vehicle;
  10. Ride bicycles, rollerblades or skateboards;
  11. manage economic activity, advertisement or agitation;
  12. enter for unauthorised persons;
  13. park vehicles containing dangerous, flammable, corrosive or explosive materials;
  14. place advertisements, billboards or banners.
  1. If the operation of Rondo Apartamenty is at safety risk, all Users of the Car Park shall be obliged to follow the orders of the security services and the Manager's and Operator’s employees, including necessary evacuation of the Car Park if such evacuation is called.
  2.  In case of a vehicle failure at the Car Park, which failure could have a negative impact on the environment and safety of other Users and vehicles, the driver shall cover the costs of actions of the Fire Department and other proper authorities necessary to remove the source of danger. Towing the vehicle at the User’s request in case of a failure requires notifying the reception of RONDO and producing the registration document of the vehicle.

§ 8

Using the Car Park shall be paid for each started day, counting from the hour of arrival at the Car Park or started hotel day (for the guests of Apartamenty Rondo). The proper amount shall be paid before parking the vehicle at the parking space. 

§ 9

The User’s failure to respect the rules of using the Car Park, specified in the Terms and Conditions, shall result in towing the vehicle to a place in Świnoujście, chosen by the Manager. The User shall cover the parking fee of up to PLN 200 for a day at the new place and the costs of towing, which shall be realised at the User’s risk. The Manager is also authorised to remove a vehicle left at the Car Park at the User’s cost and risk after the period, for which a payment was provided, expires. If the vehicle is damaged during the towing, the Manager shall not be held responsible for any damage, which the User accepts. The User hereby waives any claims against the Manager in this regard.

§ 10

Any complaints and suggestions regarding the operation of the Car Park should be communicated directly at the reception or via e-mail to the address rezerwacje@rondoapartamenty.pl.

The Terms and Conditions are available on a board at the entrance to the Car Park and at the Reception of Rondo.

Telephone to be called in order to remove a lock or indicate the place of parking of a removed vehicle, including collection of the payment specified in the agreement - provided on the lock. 

The Manager reserves the right to amend these Terms and Conditions.


RULES OF USING THE RONDO PAID UNGUARDED CAR PARK

1. The car park and security staff of the car park is managed by the Towarzystwo Budowlane ARKADA sp. z o.o., Świnoujście Monte Cassino 16/1 hereinafter called the Manager. The Operator collecting payments for parking at the Rondo Car Park shall” be ARKADA - INWEST Spółka z o. o., Szczecin, Merkatora 7, 70-67Szczecin.

2. By:

1) paying for a parking space, 

2) leaving a vehicle at the Rondo Car Park without paying for a parking space, 

the User concludes a rent agreement for a parking space at the Car Park with the Operator according to the conditions specified in the Terms and Conditions of the Car Park and the law dated April 23rd 1964, Civil Code (i.e., Dz.U. 2019, item 1145). The User shall obtain a parking card, placed on the vehicle cockpit. User parking without a parking card is obliged to pay the operator a fee of PLN 100 for each day. 

3. Liquefied gaspowered vehicles shall not be allowed to enter and park at the Car Park.

4. The vehicle may only stay at the parking space designated with the number assigned to the User by the Operator.

5. Using the Car Park shall be paid for each started day, counting from the hour of arrival at the Car Park or started hotel day (for the guests of Apartamenty Rondo). The proper amount shall be paid before placing the vehicle at the parking space.

6. The Operator shall not be held responsible for any damage to the motor vehicles parked at the Car Park nor for any belongings left in the vehicles. The Operator shall not be held responsible for any damage caused by the vehicle drivers, other persons present at the Car Park nor third persons (including theft, break-ins, mugging).

7. The vehicle User shall be responsible for all damage inflicted to the Operator or third persons at the Car Park.

8. At the Car Park it is forbidden to:

h) park vehicles containing dangerous, flammable, corrosive or explosive materials.

9. The Users of the Car Park shall be obliged to follow the orders of the security services and the Manager's and Operator’s employees. The User’s failure to respect the rules of using the Car Park, specified in the Terms and Conditions, shall result in towing the vehicle to a place in Świnoujście, chosen by the Manager. The Manager has the right to install a lock on a vehicle in case of failure to follow these rules and terms and conditions of the Car Park.
